“Personally Identifiable Information”

“Personally Identifiable Information” refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains, including, but not limited to, name, address, phone number, email address, internet protocol (IP) address, and account/profile information. Personally Identifiable Information does not include information that is collected anonymously (that is, without identification of the individual user) or demographic information not connected to an identified individual.

What Personally Identifiable Information is collected?

We may collect basic user profile information from all Visitors. We collect the following additional information from Authorized Customers and/or through forms and account tools on the Site: name, address, phone number, IP address, and email address. If you use saved searches, favorites, showing requests, or similar tools, we may also collect information related to your activity and preferences on the Site.

What organizations are collecting the information?

With whom may the information be shared?

Data will not be shared with third parties for marketing or promotional purposes.

Personally Identifiable Information pertaining to Authorized Customers and other non-personally identifiable information may be shared with our employees and with third-party service providers who assist us with Site operations or Services (for example, hosting, platform tools, analytics, customer communications, and lead management tools). These providers are contractually bound to use Personally Identifiable Information solely in connection with providing the Services and may not use it for any other purpose.

We may use customer relationship management and communication service providers to manage inquiries and communicate with you, including by email, phone, and text message. For example, we may use Follow Up Boss (FUB) to store lead information, assign inquiries, and send or coordinate communications you request. These providers may process your contact information and message content on our behalf solely to provide the Services and are not permitted to use it for their own marketing purposes.

We may disclose information provided by Visitors as part of any merger, sale, acquisition, or financing of our company. Furthermore, in some instances, we may be legally required to provide information about Visitors to government authorities, including law enforcement, Homeland Security, and intelligence agencies. We cooperate with law enforcement in identifying persons using our Services for illegal activities and reserve the right to report any activities that we believe to be unlawful or in violation of our Terms and Conditions.

If an Authorized Customer registers for an account after using Site services, cookies allow us to associate the Authorized Customer’s preferences with the newly created account.

The Company uses log-in information, including IP addresses, ISPs, and browser types, to analyze trends, administer the Site, track a user’s movement and use, and gather broad demographic information to improve performance and user experience.

What partners or service providers have access to Personally Identifiable Information?

The Company has entered into and will continue to enter into partnerships and other affiliations with vendors that support the Site and Services. Such vendors may have access to certain Personally Identifiable Information on a need-to-know basis for providing Services. This Privacy Policy does not cover their collection or use of information outside the Services we engage them to provide. Can a Visitor delete or deactivate Personally Identifiable Information?

Visitors and Authorized Customers may request data deletion/deactivation of Personally Identifiable Information by contacting us using the information above. Because of backups and recordkeeping, it may be impossible to delete all residual information. An individual who requests deactivation will have this information functionally deleted, and we will not sell, transfer, or share their Personally Identifiable Information outside of our business line.

Non-discrimination for exercising privacy rights

We do not discriminate against Visitors and Authorized Customers for exercising privacy rights. Such discrimination includes denying goods or services, charging different prices, or providing a different level or quality of service, except where permitted by law and reasonably related to the value of the consumer’s data.

We provide the following disclosures pursuant to Cal. Bus. & Prof. Code § 22575–22579.

We provide Visitors and Authorized Customers, including those claiming California residency, with information on how to exercise disclosure options and choices pertaining to Personally Identifiable Information, such as the right to opt-out or unsubscribe, or opt-in for use of Personally Identifiable Information by third parties for marketing purposes. Accordingly, pursuant to the California Civil Code, we are not required to maintain or disclose a list of third parties that have received Personally Identifiable Information for marketing purposes during the preceding year.

Governing Law and Jurisdiction

By accessing or using the Services, you agree to be bound by this Privacy Policy, which shall be governed by, and construed in accordance with, the laws of the state of Wisconsin, exclusive of its choice of law rules. For any disputes deemed not subject to binding, individual arbitration (if provided in our Terms of Service), you and the Company agree to submit to the exclusive jurisdiction of the state of Wisconsin, or, if federal court jurisdiction exists, the United States District Court for the state of Wisconsin. You and the Company waive any jurisdictional, venue, or inconvenient forum objections to such courts, as well as any right to a jury trial. The Convention on Contracts for the International Sale of Goods will not apply. Any law or regulation that provides that the language of a contract shall be construed against the drafter will not apply.
